Privacy is a hot topic and we want to make sure you feel comfortable with the limited ways in which The Providers (“we”) will use your personal information.  This Privacy Policy will lay out for you what information we collect about you and how we collect it, protect it, and the limited ways in which we share it and use it.   

  1. INFORMATION WE COLLECT.

We may collect certain information that can be used to identify you as an individual (“Personal Information”), such as your name, email address, telephone number, home address, and demographic information (such as your zip code or your age).  At some point we may collect payment information from you (such as your credit card number). Moreover, whenever you visit or interact with our site, we, as well as any third-party advertisers and/or service providers, may use a variety of technologies that automatically or passively collect information about how the site are accessed and used ("Usage Information"). We also automatically collect your IP address or other unique identifier ("Device Identifier") for the computer, mobile phone, tablet or other device you use to access the site. A Device Identifier is a number that is assigned to your device when you access a website or its servers, and our computers identify your device by its Device Identifier. We may use a Device Identifier to, among other things, help diagnose problems with our servers, analyze trends, track users' web page movements, help identify you, and gather broad demographic information for aggregate use.

  1. HOW WE USE THE INFORMATION WE COLLECT.

We use the information we collect about and from you in a few limited ways.  These include providing you with access to features of the site; verifying your identity; communicating with you; tailoring content, advertisements, and offers we serve you; and responding to your questions and requests.

  1. SHARING OF INFORMATION.

We may share your Personal Information with third parties that perform functions on our behalf (or on behalf of our partners) such as service providers that host our site, analyze data, process transactions and payments, fulfill orders or provide customer service; advertisers; sponsors or other third parties that participate in or administer our promotions, contests, sweepstakes, surveys or provide marketing or promotional assistance and "powered by" partners or partners in co-branded sites; or other users of the site.  Your Personal Information may also be used by us or shared with our subsidiaries and affiliates. In addition, we may transfer and disclose your Personal Information to third parties to comply with a legal obligation, if we believe in good faith that the law or a governmental authority requires it, to address fraud, security or technical issues, to respond to an emergency, and/or to protect our rights or property or the security of third parties.

While using our site, you may receive information and/or marketing offers from third parties or your Personal Information may be shared with other third party, including social networking sites such as Facebook or Twitter, in which case your Personal Information will be disclosed to the third party and the Personal Information you disclose will be subject to the privacy policy and business practices of that third party. These other applications and sites may send their own cookies to your device, they may independently collect data or solicit Personal Information and may or may not have their own published privacy policies. You should also independently assess the authenticity of any application or site which appears or claims that it is one of our partners (including those linked to through an email or social networking page). 

  1. INFORMATION FROM THIRD PARTIES.

We may receive information about you from third parties. If you are using another mobile application or you are on a third-party website and you opt-in to receive information from us, the third-party application or website will submit to us your email address and other information about you so that we may contact you as requested. You may also access third-party content and/or participate in a third party application or feature through which you allow us to collect or the third party to share information about you. Also, if you connect to the site using your Facebook credentials, you authorize us to collect your authentication information.  We may store this information so that it may be used in connection with the site. In addition, we may receive information about you if other users of a third party website or application give us access to their profiles and information about you is accessible through your "connections'" web page, profile page, or similar page on a social networking or other third party website, application or interactive service. 

  1. ROUTINE RECORD KEEPING.

In accordance with our routine record keeping, we may delete certain records that contain Personal Information that has been submitted or collected through the site and we are under no obligation to store such Personal Information indefinitely. We disclaim any liability arising out of, or related to, the destruction of such Personal Information.  However, it may not always be possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons. Please note that we will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. 

You have the right to be informed of, and to have access to, certain personally identifiable information we hold about you by emailing us.

We do not control certain privacy settings and preferences maintained by our third-party providers or by our social media partners, such as Facebook and Twitter. If you wish to make changes to those settings and preferences, you may do so by visiting the appropriate page of the appropriate third-party site(s).  

  1. SECURITY OF YOUR INFORMATION.

Please be aware of the fact that no electronic data transmission or storage of information can be guaranteed to be completely secure.  We cannot ensure or warrant the security of any information you transmit to us and your use of the site is at your own risk.

  1. CHAT ROOMS.

The site may make available chat rooms, forums, message boards, instant messaging and news groups. Remember that any information that you disclose in these areas becomes public information and is not subject to the provisions of this Privacy Policy.

  1. CONSENT TO PROCESSING AND TRANSFER OF INFORMATION.

The site is operated from the United States, although we may use third-party service providers that are outside of the United States, your information may be stored on servers that are outside of the United States and your Personal Information may be processed by staff operating outside of the United Stated who are engaged directly or indirectly by us or by other service providers and/or our partners. Such processing may be related to, among other things, the provision of customer care services.  By submitting your Personal Information, you agree to this transfer, storing and/or processing.  

The site is governed by and operated in accordance with the laws of the United States and is intended for the enjoyment of residents of the United States, however, to the extent that services are provided by third-party providers, those services are provided in accordance with the laws referenced in their policies that apply to their services.   By using the site, or providing us with any information, you (a) acknowledge that the site is subject to the laws of the United States, (b) consent to the collection, processing, maintenance and transfer of such information in the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen, and (c) waive any claims that may arise under those laws. We make no representation that the site is governed by or operated in accordance with the laws of any other nation.

  1. CHILDREN.

We do not knowingly collect, use or disclose personally identifiable information from anyone under the age of 13. If we become aware that we have unknowingly collected personally identifiable information from a child under the age of 13, we will make reasonable efforts to delete such information from our records.   Young people between 13 and 17 should not send any information about themselves to anyone over the Internet (including to us) without asking their parents/legal guardians for permission beforehand.

  1. GOOGLE ANALYTICS.

Our site may use Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on visitors' computers, to help the website operators analyze how visitors use the site. The information generated by the cookie about the visitors' use of the website will generally be transmitted to and stored by Google on servers in the United States.

IP anonymization may be activated on our site. The IP addresses of users visiting our site may be shortened. Only in exceptional cases will a complete IP address be transferred to a Google server in the United States and shortened there. On behalf of the website operator, Google will use this information for the purpose of evaluating the site for its users, in order to compile reports on site activity, and to provide other services relating to site activity and internet usage for website operators.

Google will not associate the IP address transferred in the context of Google Analytics with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that in this case you may not be able to use the full functionality of this website.

  1. Your Rights and Control Mechanisms

The data protection laws of the European Economic Area and other territories grant their citizens certain rights in relation to their Personal Information. While other jurisdictions may provide fewer statutory rights to their citizens, we make the tools designed to exercise such rights available to our customers worldwide.

As a resident of the European Economic Area you have the following rights in relation to your Personal Information:

11.1 Right of Access.

You have the right to access your Personal Information that we hold about you, i.e. the right to require free of charge (i) information about whether your Personal Information is retained, (ii) access to and/or (iii) duplicates of the Personal Information retained. 

11.2 Right to Rectification.

If we process your Personal Information, we shall endeavor to ensure by implementing suitable measures that your Personal Information is accurate and up-to-date for the purposes for which it was collected. If your Personal Information is inaccurate or incomplete, you can change the information you provided by contacting us.

11.3. Right to Erasure.

You have the right to obtain deletion of Personal Information concerning you if the reason why we could collect it does not exist anymore or if there is another legal ground for its deletion. 

11.4 Right to Object.

You have the right to object to the processing of your Personal Information. If you object we will no longer process your Personal Information unless there are compelling and prevailing legitimate grounds for the processing as described in Article 21 of the GDPR; in particular if the data is necessary for the establishment, exercise or defense of legal claims.  You also have the right to lodge a complaint at a supervisory authority.

11.5 Right to restriction of processing of your Personal Information

You have the right to obtain restriction of processing of your Personal Information under the conditions set out in article 18 of the GDPR.

11.6 Right to Personal Information portability

You have the right to receive your Personal Information in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller under the conditions set out in article 20 of the GDPR. 

11.7 Right to Post-Mortem Control of Your Personal Information

If French data protection legislation is applicable to you, you have the right to establish guidelines for the preservation, the deletion and the transmission of Personal Information after your death in accordance with article 40-1 of the Act No 78-17 of 6 January 1978 on Information, Technology, Data Files and Civil Liberties.
